Judge Prill Orders Resentencing For Corey Thomas After Errors Were Found In Original Sentencing

Judge Prill has ordered resentencing for Corey Eugene Ross Thomas after finding an error in his original sentencing. The prosecutor conceded that Offense Variable 19 (OV 19) was improperly scored at ten points, which will reduce the sentencing guidelines from a range of 14 to 43 months to 12 to 36 months. The court agreed, noting that the defendant's refusal to submit to a preliminary breath test, which led to the OV 19 scoring, was an exercise of his rights and not a basis for points.
However, the court upheld the scoring of Offense Variable 17 (OV 17), which concerns the degree of negligence exhibited while operating a vehicle. The defense argued against this scoring, citing no accident or injuries and no dangerous driving witnessed by the police officer. The prosecution contended that the scoring was proper, based on a report from a 14 year old passenger who expressed fear to his mother. The court found that Thomas, who had a blood alcohol content of 0.224 and two minor children in the vehicle, showed a reckless disregard for life, especially given his prior history of drinking and driving offenses.
Resentencing has been scheduled for April 27th at 11:00 AM in Bad Axe, Huron County Circuit Court.
